Terms.
This is a courtesy translation. The German version of these terms is the legally binding one. In the event of any discrepancy between the German and English texts, the German text prevails. Deutsche Fassung.
These general terms and conditions apply to all contracts between Leon Tran (Floweon) and clients concerning the provision of services in web development, AI automation and consulting.
A contract comes into effect through written order confirmation (by email). Offers are subject to change and non-binding until they have been confirmed in writing.
The scope of the services to be provided follows from the respective offer or order confirmation. Changes or extensions to the scope require a written agreement and may lead to an adjustment of the price.
All prices are in Swiss francs (CHF). Floweon is not liable for VAT, so no VAT is shown on the invoices. Invoices are payable within 30 days of the invoice date. In case of default, interest of 5% p.a. is charged.
The client provides all information, content and access required for the provision of the services in good time. Delays caused by missing cooperation are not at the expense of Floweon.
On full payment, Floweon transfers the agreed rights of use in the created work to the client. Floweon retains the right to use the project as a reference unless the client expressly objects.
Floweon is liable only for damage caused by gross negligence or intent. Liability for slight negligence as well as for indirect and consequential damage is excluded to the extent permitted by law.
Both parties undertake not to pass on confidential information of the other party to third parties and to use it exclusively for the agreed purpose.
Swiss law applies. The exclusive place of jurisdiction is the registered seat of Floweon in Switzerland. The contract language is German.
